1. About these terms
This website at homeownerassist.com.au (the Site) is operated by Homeowner Assist Pty Ltd (ABN 20 668 294 460) (Homeowner Assist, we, us, our). By accessing or using the Site you agree to these Terms of Use and to our Privacy Policy. If you do not agree, please do not use the Site.
2. What we do — and what we do not do
Homeowner Assist provides education and program coordination services only. We do not provide financial product advice within the meaning of the Corporations Act 2001 (Cth). We do not provide credit advice or credit assistance within the meaning of the National Consumer Credit Protection Act 2009 (Cth). We do not provide legal, taxation or accounting advice. We do not act as a buyer’s agent or real estate agent. We do not hold an Australian Financial Services Licence, an Australian Credit Licence, or a real estate agent’s licence.
Where the Site refers to credit proposals, assessments, loans or financial products, those are prepared, assessed and provided by separately licensed third parties (our licensed partners), not by us. Our licensed credit partner is YourLoanAssist (Australian Credit Licence 477483). Any decision to engage a licensed partner is yours, and your relationship with that partner is governed by their own terms.
3. How we are paid
Homeowner Assist is a referral partner of Super Property Homes Pty Ltd and receives referral payments from Super Property Homes Pty Ltd in connection with clients we refer to them. This is a commercial arrangement, and you are free to take it into account when deciding whether to proceed.
Super Property Homes Pty Ltd is a separate company from Homeowner Assist. Any credit or financial advice you receive is provided by separately licensed providers under their own legal obligations. 4. General information only
All content on the Site is general information and educational material. It does not take into account your objectives, financial situation or needs, and it is not a recommendation to acquire any product, enter any arrangement or take any course of action. Before acting on anything on the Site you should consider whether it is appropriate for your circumstances and obtain independent legal, financial and credit advice from appropriately licensed advisers.
Descriptions on the Site of how a program or process works are illustrative. Eligibility for any program or product is determined solely by the relevant licensed partner through their own assessment. Nothing on the Site guarantees that you will be assessed as eligible, be approved for any loan or arrangement, or purchase or settle on any property. Case studies and client stories describe individual experiences and are not indicative of outcomes for others.
5. Eligibility indicators on the Site
The Site includes short question sets that apply fixed, general rules to your answers to indicate whether an information call is likely to be useful. These indicators are not an assessment of your eligibility for anything and are not advice. They may be wrong in either direction. You are welcome to contact us regardless of the indication the Site gives you.
6. Using the Site
You may use the Site for your own personal, non-commercial purposes. You must not:
- use the Site for any unlawful purpose or in breach of any applicable law;
- copy, reproduce, scrape, harvest or republish Site content, other than as permitted under section 7;
- attempt to gain unauthorised access to the Site, its servers or any connected system;
- interfere with the Site’s operation or introduce malicious code; or
- submit false, misleading or another person’s information through any form or booking tool.
7. Intellectual property
The Site and its content — including text, graphics, logos, page design and downloadable material — are owned by or licensed to Homeowner Assist and are protected by Australian and international intellectual-property laws. You may view, download and print Site content for your personal reference, provided you keep all copyright and other notices intact. Any other use requires our prior written permission.
8. Third-party content and links
The Site embeds content and tools provided by third parties (for example a booking calendar and video players) and may link to external websites, including government scheme pages and our licensed partners’ websites. We do not control third-party content or sites, do not endorse them, and are not responsible for their content, availability, accuracy or privacy practices. Your use of third-party tools and sites is subject to their own terms.
9. Accuracy and availability
We take reasonable care to keep the Site accurate and up to date, but we do not warrant that the Site or its content is complete, current, error-free or free from viruses, or that it will be available without interruption. Program rules, government schemes, lending criteria and market conditions change, and content on the Site may not reflect the most recent changes.
10. Liability
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.
Subject to that, and to the maximum extent permitted by law: (a) the Site and its content are provided “as is” and we exclude all warranties, express or implied; (b) we are not liable to you for any loss or damage — including loss of profit, opportunity or data, and any indirect or consequential loss — arising out of or in connection with your use of, or reliance on, the Site or its content, however caused; and (c) where liability cannot be excluded but can be limited, our liability is limited, at our option, to re-supplying the relevant information or paying the cost of having it re-supplied.
11. Complaints
If you have a complaint about the Site or about our education and coordination services, please email admin@homeownerassist.com.au with the subject line “Complaint”. We will acknowledge your complaint within 7 days and aim to resolve it within 30 days. Privacy complaints are handled as set out in our Privacy Policy.
Complaints about credit assistance, credit advice or financial advice provided by a licensed partner should be directed to that partner, who is required to maintain their own dispute-resolution process. Unresolved complaints of that kind may be taken to the Australian Financial Complaints Authority (AFCA) at afca.org.au.
12. Privacy
Our collection, use and disclosure of your personal information is governed by our Privacy Policy, which forms part of these terms.
13. Changes
We may change these terms at any time by publishing the updated terms on the Site. Your continued use of the Site after a change constitutes acceptance of the updated terms. The date of the current version is shown at the top of this page.
14. Governing law
These terms are governed by the laws of Queensland, Australia. You submit to the non-exclusive jurisdiction of the courts of Queensland and courts competent to hear appeals from them.
